COMMONLY USED COURT TERMS
7411 [MCL 333.7411]. Section 7411 of the Public Health code provides for a plea without conviction for a first time drug offender. If the Court sentences the defendant under 7411 and he/she successfully completes a probationary period, the case is dismissed and conviction. The use of 7411 is within the sole discretion of the judge and applies to possession and use cases.
HYTA [Holmes Youthful Trainee Act]. HYTA (MCL 762.11 through 762.16 provides judges with a means of ordering rehabilitative treatment and/or confinement for up to three years for youthful offenders [17 – 21 years old] without proceeding to an adjudication of guilt and/or a criminal conviction.
